Sixth Circuit Court of Appeals ruled the district court improperly limited Plaintiff's claims


Lindsay v. Yates (6th Cir. 2009)

Case # No. 08-3633

Sixth Circuit Court of Appeals ruled that a prima facie case of housing discrimination is established whenever the actions taken by the property owner lead one to reasonably infer, if such actions remain unexplained, that it is more likely than not that such actions were based on discriminatory criterion such as race.

 

Talley v. Family Dollar Stores of Ohio (6th Cir., 2008)

The court held that the breakdown of the interactive process can, in and of itself, constitute a constructive discharge of an employee.

 

Hollenbaugh v. Maurer, et al.
Case # 5:05 CV 00207
Police misconduct against officers of Wayne County, Ohio
Sixth Circuit Court of Appeals affirmed the District Court’s denial of summary judgment on claims versus the individual police officers. The case settled shortly thereafter for over six figures in 2007.

Court held that the City of Akron had discriminated based on race in police and fire promotions.

Trial court held that the state prison warden had violated the civil rights of the inmate.
